These Terms and Conditions ("Terms") govern your access to and use of the Peoria Heights Chamber of Commerce mobile application (the "App") and any related websites, content, features, and services provided by Peoria Heights Chamber of Commerce ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Use of the App

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law or regulation

  • Interfere with the operation or security of the App

  • Attempt unauthorized access to systems or accounts

  • Upload malicious code or harmful content

  • Use the App in a way that could damage, disable, or impair services

  • Misrepresent your identity or affiliation

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with permission of a parent or legal guardian.

3. Accounts and User Submissions

Some features may allow you to submit forms, inquiries, reviews, event registrations, or other content. You are responsible for information you submit and agree it will not be unlawful, defamatory, infringing, misleading, or harmful.

We may remove content or restrict access at our discretion.

4. Tourism and Business Information

The App may provide information about local businesses, events, attractions, promotions, dining, lodging, maps, hours, and directions. We strive for accuracy, but do not guarantee that any listing or information is complete, current, or error-free. Details may change without notice.

You should independently verify pricing, availability, hours, reservations, accessibility, safety conditions, and event details with the relevant provider.

5. Third-Party Services

The App may link to or integrate with third-party websites or services. We do not control and are not responsible for third-party content, products, services, or practices. Your use of third-party services is subject to their own terms and policies.

6. Intellectual Property

The App and its content, including text, graphics, logos, designs, software, and compilations, are owned by us or our licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, create derivative works from, or exploit any part of the App except as expressly permitted by law or with written permission.

7. App Store Terms

If you downloaded the App through an app marketplace such as the Apple App Store or Google Play, you also agree to any applicable marketplace terms. Apple and Google are not responsible for providing maintenance or support for the App except as required by law.

8. Privacy

Your use of the App is also governed by our Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the App will be uninterrupted, secure, error-free, or free of harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEORIA HEIGHTS CHAMBER OF COMMERCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO USE THE APP, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Peoria Heights Chamber of Commerce and its affiliates from claims, liabilities, damages, losses, and expenses arising from your misuse of the App, your violation of these Terms, or your violation of any rights of another party.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we believe you violated these Terms or if necessary to protect users, systems, or our interests.

13. Changes to the App or Terms

We may modify, suspend, discontinue, or update the App or these Terms at any time. Updated Terms become effective when posted. Continued use of the App after changes means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles, except where otherwise required by applicable law.
